Bidder(s) participating in Auction/Tender/Listing accept the Scrapcart Terms & Conditions by clicking on the acceptance button before submitting their bids on the Scrapcart platform. These Terms and Conditions govern your access to and use of our services. By registering and using the Scrapcart platform, you agree to abide by these terms. Please review them carefully before accessing and using the services of SCRAPCART and its related sites.

1. General Terms

  1. By registering and availing of services on Scrapcart, you acknowledge that access to these services is subject to Scrapcart’s discretion, ensuring the best experience for all users.
  2. Information and services provided on the Scrapcart platform are subject to change and may be updated without prior notice.

2. Information Accuracy and Responsibility

  1. Scrapcart strives to provide accurate, updated and reliable information. However, in the event of any inaccuracies in information from original sources, Scrapcart will not be held liable for any resulting impacts.
  2. Prices, services, and information displayed on the platform are indicative and may vary. Scrapcart is not obligated to provide real-time updates or assume responsibility for direct or indirect losses arising from outdated information.

3. Auction Transactions and Delivery

  1. Scrapcart acts as a facilitator and does not directly handle the delivery of products. Buyers and sellers are responsible for coordinating deliveries, addressing delays, or resolving issues related to product damage.
  2. Prices listed are valid exclusively for the scheduled period. Users are encouraged to refer to the seller's details for updated pricing information.

4. Payment Terms

  1. Payments made to Scrapcart must adhere to the prescribed formats. Non-compliance with these guidelines may result in the return of the submitted instrument for proper processing.
  2. Scrapcart strictly operates on cashless transactions to maintain transparency and security. Users are advised to refrain from cash dealings with any employee and/or representatives of Scrapcart and its entities. Scrapcart and its entities will not be liable for any loss incurred due to such unauthorised transactions and therefore deny fulfilment of services/products instead of such transactions. For any unauthorised transactions, please report them immediately to support@scrapcart.com for resolution.

5. GST Compliance

  1. Customers must ensure their GST details are correct and updated on Scrapcart. Customers must update their GST information on the portal within three working days of making any payment in any form, i.e. online payment mode or offline payment mode. Failure to comply will result in billing as an unregistered GST customer, forfeiting eligibility for input tax credit claims.
  2. Scrapcart will not issue GST-compliant invoices for payments made without proper GST information updates.

6. Earnest Money Deposit (EMD) Payment

  1. EMD must be paid as per the terms specified in the auction/tender/listing notice. Payments must be made within the stipulated timelines using the designated payment methods.
  2. Scrapcart reserves the right to reject EMD payments not received in the prescribed format or within the specified time frame.
  3. EMD paid for auctions/tenders/listings is non-transferable between auctions/tenders/listings unless expressly agreed by Scrapcart.

7. Refunds

  1. Refunds for EMD or other payments are processed (within 5-7 days) as per Scrapcart’s refund policy.
  2. Refunds will only be issued to the same account or payment mode used for the initial transaction.
  3. In case of auction cancellations or non-allocation of items, refunds will be initiated automatically (within 5-7 days) without the need for user intervention.
  4. Scrapcart is not liable for delays caused by third-party payment gateways or banks in processing refunds.

8. Security and Data Privacy

  1. All transactions and data are encrypted to ensure security. Users must safeguard their account credentials and promptly notify Scrapcart of any suspicious activity.
  2. Scrapcart cannot be dragged for non-updation of the information on the site in any court of law except as expressly provided herein, Scrapcart neither makes nor provides any representation or warranty, express or implied, as to the services or any software, equipment or systems, including without limitation, any implied warranty of merchantability or fitness for a particular purpose, or arising from course of performance or course of dealing, or that the services shall be provided error-free or uninterrupted. 
  3. Scrapcart makes no representation or warranty with respect to, and shall not be responsible or liable for, any (a) corruption, damage, loss or mis-transmission of data, (b) security of data during transmission via public telecommunications facilities or (c) of the content of any data provided by the client or the client’s representatives on the site.

Bidder(s) participating in Auction/Tender/Listing accept the Scrapcart Terms & Conditions by clicking on the acceptance button before submitting their bids on the Scrapcart platform.

  1. Subject to the reserve price, if any, fixed by the Vendor and subject to the terms and conditions set out herein, the sale shall be made to the HIGHEST BIDDER on “AS IS WHERE BASIS ”and“ NO COMPLAINT BASIS.” The Vendor does not undertake any responsibility to procure any permission/license, etc.
  2. Photographs of scrap listed on Scrapcart are at best indicative only and do not necessarily reflect the actual condition of lots. All bidders are advised to physically inspect the offered lots before participating in the auctions/tenders/listings on Scrapcart.
  3. Vendor reserves the right to modify and amend the Terms & Conditions and announce the same at any time before the auction/tender/listing concludes. 
  4. Announcements during the auction/tender/listing on the website/Application/Online/Offline modes, including announcement of any additional conditions OR corrections in the catalogue, and/or additions or deletions of items being offered for sale, are being made with the consent and knowledge of the Vendor, and it is binding on the bidder.
  5. Vendor and Scrapcart are not responsible for any damages, including damages that result from, but are not limited to, negligence. Scrapcart and its team will not be held responsible for consequential damages, including but not limited to system problems, inability to use the system, loss of electronic information, etc.
  6. In the event of failure on the part of the successful bidder to fulfil his contractual obligations, Vendor/Scrapcart reserves the right to debar such bidder from participating in any future auction/tender/listing conducted by Scrapcart on behalf of Vendor.
  7. Buyers will need to pay a refundable EMD/deposit as specified by the Vendor. The Vendor reserves the right to forfeit the EMD/deposit for non-adherence to any / various conditions/clauses as laid down during the auction. This deposit amount will not be adjusted in the material bill but refunded on successful completion of the contract, within 2 days of the last lifting of material, unless otherwise decided by the Vendor, agreed in writing and communicated to Scrapcart.
  8. The highest bidder does not get any right to demand acceptance of his offer. Vendor reserves the right to accept/reject/cancel any bid, withdraw any portion of the listed property at any stage from Auction/Tender/Listing, even after acceptance of bid/issue of delivery order or release order/deposit of full value by the successful bidder, without assigning any reason thereof. In the event of such rejection/cancellation/withdrawal, Vendor shall refund the value of the listed property, if paid for, to the successful bidder. Vendor shall not be responsible for any damages/loss whatsoever to the successful bidder on account of such withdrawal.
  9. Time is the essence of the contract, and the successful bidder should start lifting the material with immediate effect on the award of the contract after depositing the cost of the material/EMD as per the Contract.
  10. Penalty for non-lifting of scrap: In case the materials are not lifted from the factory as indicated in the offer schedule or by Vendor, Vendor reserves its rights to dispose it off to any other party and loss will be made good by the successful tenderer and Vendor will be at liberty to adjust the amount of EMD and cost of material, the loss and damages suffered by Vendor due to re-awarding of the contract to any other party.
  11. Buyers must ensure that all purchased scrap material is cleared from the premises of the Vendor in a timely manner. No scrap or material should remain on the ground at the end of each week, on the 15th, or on the last working day of the month. All remaining scrap must be contained within designated bins. Failure to comply with these housekeeping and clearance requirements may attract a penalty of up to Rs. 25,000/-.
  12. All payments shall be made in the form of RTGS/NEFT in favour of the VendorThe successful bidder(s) will be intimated about the acceptance of the offer and will be required to deposit the full cost of materials and applicable sales tax and duties within 1 day, failing which the Vendor will award the contract to any other party at the cost of the successful tenderer(s), and the EMD shall be forfeited. The successful bidder shall also be liable to pay damages to the Vendor arising out of non-deposit of price and re-awarding of the contract by the Vendor to any other party, which will also include suspension of the Buyer from Scrapcart for a minimum period of 3 monthsNO OTHER MODE OF PAYMENT WILL BE ACCEPTED.
  13. The successful bidder(s) shall also be liable to pay loss and damages. No extension will normally be permitted either for the deposit of the amount or for lifting the materials. IN this case, EMD will be forfeited by the Vendor in Such extension. The extension will be valid only if permitted in writing by the Vendor.
  14. Dispatch will be given only once a day. No Delay in Lifting of Material & Payments. Vehicles should be placed daily. Failing the same EMD will result in forfeiture.
